- Attempt to scrape, harvest, bulk download, or systematically extract live aviation or radar data made available through the Service, or use automated means to access the Service in a way that could impair our systems or violate third-party data terms.
- Interfere with or disrupt the Service, our servers, networks, or other users' access—including by introducing malware, probing for vulnerabilities without authorization, or overloading infrastructure.
- Misrepresent your identity, circumvent access controls, or use the Service for any unlawful purpose.
We may suspend or terminate access for conduct that violates these Terms or puts the Service or others at risk.
Subscriptions and Elite Tier
The Service operates on a freemium model: certain features are available without charge, while Elite Tier offers enhanced or premium functionality for a monthly recurring fee, billed in advance each billing cycle until you cancel.
Pricing, included benefits, and payment methods are presented at checkout or in your account. By subscribing to Elite Tier, you authorize us (and our payment partners) to charge your payment method on a recurring basis according to the plan you select. You may cancel your subscription through the account or billing tools we provide; cancellation typically takes effect at the end of the current billing period unless stated otherwise. We do not guarantee refunds except as required by law or as explicitly offered in writing.
Third-party data and limitation of liability
The Service may display or rely on third-party live flight or aviation data. That data is provided for entertainment and informational purposes as part of the game. We do not guarantee accuracy, completeness, timeliness, or availability of any flight, position, schedule, or radar information, and we are not responsible for errors, omissions, delays, or interruptions originating from third-party sources or networks.
To the fullest extent permitted by applicable law, the Service is provided "as is" without warranties of any kind. Our total liability arising out of or related to the Service is limited as permitted by law; some jurisdictions do not allow certain limitations, in which case those limitations apply only to the extent allowed.
Changes and governing law
We may update these Terms from time to time. We will post the revised Terms on ThePlaneGame.net and, where appropriate, notify you. Continued use after changes become effective constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where preempted by applicable federal law or mandatory rules in your jurisdiction.
